Terms of service
ALULA GROUP LLC d/b/a THE MOST HOT PILATES MIAMIPlease read these Terms of Service (“Terms”) carefully before booking classes, purchasing memberships, or using the facilities of ALULA GROUP LLC, a Florida limited liability company, doing business as THE MOST HOT PILATES MIAMI (“The Studio,” “we,” “us,” or “our”).
By booking a class, purchasing a package or membership, or entering the Studio, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Membership Agreements and Liability Waiver, which collectively constitute a binding contract between you (“Client,” “Member,” or “you”) and the Studio.
HEALTH & SAFETY
You represent that you are in good physical condition and able to safely participate in physical exercise. You acknowledge that participation in Pilates, yoga, barre, infrared-heated exercise, and related fitness activities involves inherent risks, including serious injury, illness, or death.
You acknowledge that some classes may be conducted in elevated temperatures, including infrared-heated environments that may exceed 100°F, and that such conditions may increase risks of dehydration, dizziness, fainting, heat exhaustion, hyperthermia, and cardiovascular stress. You voluntarily assume all such risks.
Nothing in these Terms constitutes medical advice. You are solely responsible for consulting with a physician regarding your fitness for participation.
PREGNANCY, POSTPARTUM, INJURY & MEDICAL CONDITIONS
For safety reasons, pregnant clients are not permitted to participate in infrared-heated classes. Elevated core body temperature during pregnancy may pose risks to both mother and fetus.
Clients who are pregnant, postpartum, recovering from injury, or who have medical, orthopedic, cardiovascular, neurological, or sensory conditions must notify the instructor prior to class and obtain medical clearance before participation. The Studio reserves the right to refuse participation where it reasonably believes continued participation may pose a risk to the client.
CLASS BOOKINGS, CANCELLATIONS & NO-SHOWS
All classes must be reserved in advance through the Studio’s booking system.
Cancellations must be made no later than twelve (12) hours prior to the scheduled class time. Late cancellations, failure to cancel, or failure to attend a reserved class will result in forfeiture of the class credit. For auto-renewing or unlimited memberships, late cancellations or no-shows will result in a $25 fee charged to the card on file.
RETURNS, REFUNDS & STATUTORY RIGHTS
Except as required by Florida law, all purchases of services (including memberships, class packs, drop-ins, workshops, and events) are non-refundable, non-transferable, and non-exchangeable.
Nothing in these Terms limits your statutory rights under the Florida Health Studio Act, including but not limited to the three-day right of rescission, death or disability cancellation rights, relocation rights, or any refund rights required by Florida Statutes §501.017, all of which are governed by your Membership Agreement.
Unused merchandise may be returned within seven (7) days of purchase with receipt for a full refund. No refunds are provided without proof of purchase.
WORKSHOPS & EVENTS
Workshops and special events are non-refundable unless otherwise expressly stated in writing. The Studio reserves the right to modify or cancel events due to instructor availability, enrollment, or circumstances beyond its control.
PERSONAL PROPERTY
The Studio is not responsible for lost, stolen, or damaged personal property. You assume all risk for personal items brought onto the premises.
NON-HARASSMENT & CONDUCT
The Studio maintains a zero-tolerance policy for harassment, discrimination, intimidation, or inappropriate conduct. The Studio reserves the right to suspend or terminate access for any individual who violates this policy.
INTELLECTUAL PROPERTY
All content, trademarks, logos, class formats, and materials are the exclusive property of ALULA GROUP LLC d/b/a THE MOST HOT PILATES MIAMI and may not be reproduced or used without written authorization.
PHOTO, VIDEO & RECORDING CONSENT
By attending classes or events, you acknowledge that photography, video, and audio recording may occur and that your image and likeness may be used in accordance with the Photo & Media Release contained in your Liability Waiver, unless you notify management in writing prior to participation.
MODIFICATION OF TERMS
The Studio reserves the right to modify these Terms from time to time. Updated Terms will be posted and/or provided electronically. Continued use of Studio services after notice of changes constitutes acceptance of the revised Terms.
GOVERNING LAW & VENUE
These Terms shall be governed by and construed in accordance with the laws of the State of Florida. Venue for any dispute shall lie exclusively in Miami-Dade County, Florida, subject to the arbitration provisions contained in the Liability Waiver.
